1. 📖 Definitions

"MineTopia", "we", "us" and "our" refer to the MineTopia Minecraft network and the individuals or organization operating it.

"Player", "you" and "your" refer to any person accessing or using the MineTopia Services.

"Services" includes the MineTopia Minecraft servers, website, store, Discord community and other services operated by MineTopia.

2. 👤 Eligibility

You may use MineTopia provided that you are legally permitted to use the Services and comply with these Terms and all applicable laws.

3. 🎮 Minecraft Account

You are responsible for maintaining the security of your Minecraft account and any account used to access MineTopia.

MineTopia is not responsible for losses resulting from you sharing your account credentials or allowing another person to access your account.

You must not impersonate another player, staff member, administrator or representative of MineTopia.

4. 🚫 Server Rules

Players must comply with the MineTopia Server Rules, including rules communicated in-game, on the website, Discord or through official MineTopia announcements.

Prohibited behaviour may include, but is not limited to:

• ❌ Cheating or using unauthorized modifications.
• 🐛 Using exploits or intentionally abusing bugs.
• 🔐 Hacking or attempting to gain unauthorized access.
• 🚫 Harassment, threats or targeted abuse.
• 💰 Scamming or fraudulent activity.
• 🎭 Impersonating MineTopia staff.
• 📢 Advertising unauthorized services or servers.
• 💥 Attempting to disrupt or damage MineTopia services.
• ⛔ Evading punishments or bans.
• 📜 Any other conduct prohibited by the MineTopia Server Rules.

5. 🛡️ Moderation and Punishments

MineTopia reserves the right to investigate suspected violations of these Terms and the Server Rules.

Depending on the circumstances, MineTopia may issue warnings, temporary punishments, permanent bans, mutes, restrictions or other appropriate actions.

Attempting to evade a punishment may result in additional restrictions or punishment.

6. 👮 Staff Decisions

MineTopia staff are responsible for enforcing the Server Rules and maintaining the integrity of the community.

Staff decisions may be reviewed or appealed through the official MineTopia support or appeal process where such a process is available.

7. 🛒 Purchases

MineTopia may offer digital products, ranks, cosmetics, perks, packages, virtual items and other digital content through its official store.

Purchases are processed through third-party payment providers and store platforms, including Tebex where applicable.

By making a purchase, you confirm that you have the legal authority to use the payment method and that the information provided during checkout is accurate.

8. 💎 Digital Products and Virtual Items

Products purchased from the MineTopia store are digital products or services unless explicitly stated otherwise.

Digital ranks, cosmetics, permissions, virtual currency, keys, items and other in-game benefits have no cash value and cannot be exchanged for real-world currency by players unless explicitly authorized by MineTopia.

9. 🔒 Purchases and Account Restrictions

MineTopia may restrict or suspend access to purchased digital content where necessary due to fraud, payment disputes, chargebacks, unauthorized transactions or violations of these Terms, subject to applicable law.

Players should contact MineTopia support before initiating a payment dispute where the issue can reasonably be resolved through our support process.

10. 💳 Chargebacks and Payment Fraud

Intentionally initiating a fraudulent chargeback or payment dispute for a legitimate purchase may result in the restriction or removal of the associated MineTopia account or purchased benefits.

11. 💰 Refunds

Refunds are subject to the MineTopia Refund Policy and applicable consumer-protection laws.

Please review our Refund Policy before making a purchase.

12. 🌐 Server Availability

MineTopia aims to provide reliable and stable Services but does not guarantee that the Services will always be available, uninterrupted or completely free from errors.

Maintenance, updates, technical problems, security incidents, network problems or circumstances outside our reasonable control may temporarily affect availability.

13. 🔄 Updates and Changes

MineTopia may modify, update or discontinue parts of the Services, including game modes, features, maps, plugins, systems, digital products and other content.

We may also update these Terms from time to time. Updated Terms will be published on this page together with a new "Last Updated" date.

14. 🧱 Player Content

Players may create content within MineTopia, including builds, messages, screenshots and other in-game content.

You are responsible for ensuring that content you submit or create does not knowingly violate applicable laws or the rights of others.

MineTopia may remove or restrict player content that violates our rules, these Terms, applicable law or the safety of the community.

15. 🐛 Exploits and Security Vulnerabilities

Players must not intentionally exploit security vulnerabilities, bugs or weaknesses in MineTopia systems for personal advantage, disruption or unauthorized access.

16. ©️ Intellectual Property

MineTopia and its licensors retain rights in MineTopia's original branding, website content, graphics, software, server configurations, logos and other proprietary materials, except where otherwise stated.

You may not copy, reproduce, redistribute, sell or commercially exploit MineTopia's proprietary materials without authorization.

Minecraft Disclaimer

Minecraft and related intellectual property remain the property of their respective owners. MineTopia is an independent server and is not affiliated with or endorsed by Mojang or Microsoft unless explicitly stated.

17. 🚫 Prohibited Commercial Activity

Players may not use MineTopia to conduct unauthorized commercial activity, advertise competing services, sell accounts or engage in activities that violate MineTopia rules or applicable law.

18. 🔐 Account and Service Restrictions

MineTopia may suspend or terminate access to the Services where reasonably necessary due to serious violations of these Terms, security threats, fraud, abuse, unlawful activity or conduct that significantly harms the MineTopia community or infrastructure.

19. ⚠️ Disclaimer

The MineTopia Services are provided on an "as available" basis.

To the extent permitted by applicable law, MineTopia does not guarantee that the Services will be uninterrupted, error-free or permanently available.

20. ⚖️ Limitation of Liability

To the maximum extent permitted by applicable law, MineTopia will not be responsible for indirect, incidental or consequential losses arising from the use of the Services.

21. 🔒 Privacy

Personal information collected through the MineTopia Services is handled in accordance with our Privacy Policy.

22. 🔗 Third-Party Services

MineTopia may integrate with third-party services such as Tebex, Discord, hosting providers and other external platforms.

MineTopia is not responsible for the availability, policies or practices of third-party services that are outside our control.

23. ⚖️ Applicable Law

These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory rights or protections provided by applicable law.

24. 🧩 Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the extent necessary to comply with applicable law, while the remaining provisions will continue to apply to the extent permitted by law.

25. 📄 Entire Agreement

These Terms, together with the MineTopia Privacy Policy, Refund Policy, Server Rules and any other policies expressly incorporated into these Terms, form the agreement governing your use of the MineTopia Services, subject to applicable law.
